IF YOU DO NOT UNDERSTAND OR AGREE WITH THE EULA AND DO NOT ACCEPT THESE TERMS, DO NOT DOWNLOAD OR USE THE PAIN DIARY APP AND IMMEDIATELY DELETE ALL FILES, IF ANY, ASSOCIATED WITH THE ACCOMPANYING SERVICES AND MATERIALS FROM YOUR DEVICE(S).
This Pain Diary’s Privacy Policy (“Privacy Policy”) is a part of our End User License Agreement ("EULA"), which is a legal agreement between any end user of OPES Groups’ products and services (“You” or “Your”) and OPES Groups (“Us”, “Our”, “We”), for Your access to and use of the Pain Diary: Map and Track Your Hand Pain that links to this EULA (together with any successor applications thereto, the “App”) and our websites (including web applications), portals, or systems that link to this EULA (together with any successor applications, thereto, the “Site”). The App and the Site together with any back-end functionalities relating thereto are collectively called the “Services” in this EULA.
Privacy is a fundamental human right. At OPES Groups, it is one of Our core values. We believe what data You share, and who You share it with, should be up to you. We are committed to ensure the privacy of individuals and that is the reason We designed the App in a way to protect Your privacy and give You complete control over Your information.
This page is used to inform visitors regarding Our policies with the collection, use, and disclosure of Personal Information if anyone decided to use Our Service.
If You choose to use Our Service, then You agree to the collection and use of information in relation to this policy. The Personal Information that We collect is used for providing and improving the Service. We will not use or share Your information with anyone except as described in this Privacy Policy.
The terms used in this Privacy Policy have the same meanings as in EULA, which is accessible at App unless otherwise defined in this Privacy Policy.
CAPTURED PHOTOGRAPHS
The App allows You to capture photographs and/or select photographs/images from Your camera roll (the “Captured Photographs”) of the affected/problematic area (example: hand, wrist, fingers, etc.,) and pinpoint the pain points by placing “X” marks and highlight large areas by drawing on the photographs/images.
VOICE RECORDS
The App allows You to record audios (the “Voice Records”) to make the App more accessible to the user when and if the user feels convenient to record a voice message instead of typing. The user can choose to record audios to describe the medical condition or a pain event such as the type of pain, symptoms, how it started, etc.
How We Manage the Captured Photographs and Voice Records (the “Media Data”)
We know that these Captured Photographs and Voice Records (the “Media Data”) are personal and sensitive information to the users and should be kept private and that is why We do not have access to any of Your Media Data.

When You choose to capture/select a Photograph via Your camera or camera roll (if You have granted Us permission to access Your camera or camera roll), and choose to record a Voice Record (if You have granted permission to access Your microphone), Your Media Data will be stored to the App alone and We do not collect Your photo albums even if You grant Us Your access to them.
Since the app completely works offline and You are in complete control of the App Data, no Media Data leave Your local device unless until You choose to share them as exported PDF document, screenshots, etc.
To further increase the security and safety of Your Media Data, We strongly recommend You to read the precautions below, before You Capture a Photograph or create a Voice Record using the App.
When You choose to capture a photograph/choose an image from Your camera roll of the affected/problematic area,

Make sure You do not have any sensitive information (such as Your card details, bank information, Social Security number, etc.,) inside the photograph/image.

Make sure You are not capturing someone else’s private or copyrighted information by any means.

Avoid taking pictures of naked children/adult, inappropriate poses that are absolutely inappropriate or irrelevant to medical/clinical purposes.

Understand that You hold full responsibility for any information that is contained within the Captured Photographs which You may choose to print or share it as a Pain Record in the form of PDF document to the people You trust (such as Your doctor, nurse, any health care provider, family, or friends).
When You choose to create a Voice Record to describe the problematic condition,

Make sure that You do not disclose any of Your or other’s sensitive information (that is inappropriate for medical/clinical purposes) such as private or phone conversation.

Make sure You do not record someone else’s private or copyrighted content such as music, movies, etc., by any means.

Understand that You hold full responsibility for any information that is contained within the Voice Records which You may choose to play in the presence of the people You trust (such as Your doctor, nurse, any health care provider, family, or friends).
PERSONAL INFORMATION
As We mentioned above, Your privacy is very important to us. It is Our policy to respect Your privacy regarding any information You enter into the App. Your Personal Information never leaves Your device.
You are free to refuse Our requests in future versions for Your personal information, with the understanding that We may be unable to provide You with some of the desired Services.
PAIN RECORDS
You can choose to share Your Pain Records with the people You trust. As the primary purpose and goal of the App, You can capture a photograph or choose an image from Your camera roll of the affected/problematic area (example: Your hand, wrist, fingers, etc.,), store them and share as individual or multiple Pain Records in PDF format to Your Health Care Provider to track. Before sharing the Pain Records, You can choose to preview the PDF document by going to Share > Print > Preview.
Your Health Care Provider, Family, and/or Friends will not receive any notification when Your data is created, store, or available. Only You can choose to share any selected data. Once You share Your Pain Records as individual records or multiple records from the App, it will generate a PDF document of the above-mentioned data in a similar structure for You to print as a physical copy or share it via third-party apps such as messages, email, etc.
No Health Information will be shared with Your Health Care Provider, Family, and/or Friends unless until You manually share the next time.
HEALTH PROFILE
In the App, You can create a Health Profile that contains information about Your height, weight, blood type, medical conditions, allergies, medications, and more. You can choose to select a photograph/image of yourself from Your camera roll (if You have granted Us permission to access Your photo library/camera roll) to set a “Display Picture” for Your Health Profile. Only Your name, date of birth, age, and gender (not mandatory) from the Health Profile will be shared when You choose to share a Pain Record as a PDF document. You can create, review, edit, or delete any Health Profile data by going to Profile Tab (at the right bottom corner) > Edit (at the right top corner) and entering the information there.
You remain in control over which information is added to the Health Profile and how long that data is stored in the App. You can review, edit, and delete Your Health Profile data at any time.
At all times, information collected by OPES Groups will be treated in accordance with Pain Diary’s Privacy Policy.
How We Manage Your Pain Records and Health Profile data (“Health Information”)
The App can store Your Pain Records and Health Profile data (“Health Information”) to give You a more comprehensive view of Your Health Information in one convenient place. You are in control over which App Data are stored in the app and which App Data is shared with third-party apps, and people You trust such as Your Health Care Provider, Family, and/or Friends.

You can choose to share Your Health Information in the form of individual or multiple Pain Records as a PDF document, including the Media Data entered by You.
CHILDREN'S PRIVACY
These Services do not address anyone under the age of 13 directly. We do not collect any personal or identifiable information from the people of any age. Parents or guardians can choose to enter the Health Information by carefully reviewing them. If You are a parent or a guardian and You are aware that Your child has entered their personal information into the App without Your knowledge, We strongly recommend You to delete the information accordingly.
As part of the process of creating a Health Profile for Your child, We will ask You to enter the information required to create a profile which may include Your child's full name, Display Picture, date of birth, gender, height, weight, language, nationality, blood type, medications, allergies, social history, family history, etc., which do not leave Your local device unless until You choose to share them as exported PDF document, screenshots, etc.
In Pain Diary’s Privacy Policy, We will not use or share any of Your child’s information with anyone.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
SECURITY
We seek to protect Your App Data (all Personal Information, Pain Records, Health Profile data, Health Information, Captured Photographs, Voice Records, Media Data, etc.,) from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of App Data. You should also help protect Your data by appropriately selecting and protecting Your password and/or other sign-on mechanism; limiting access only to Your devices.
RETENTION
Since We do not collect, store, use, process, and share any of Your App Data, We do not retain any of Your information.
CHANGES TO THIS PRIVACY POLICY
We may update Our Privacy Policy from time to time. Thus, You are advised to review this page periodically for any changes. You can check this page for any changes in Our Privacy Policy in the future.
